Introduction

Stryker recognizes that the personal information it receives is held in a position of trust. Stryker seeks to fulfill that trust by adhering to general principles regarding the protection of personal information. This Privacy Statement explains how we collect, use, share, and protect information gathered through this Site and during other interactions. 

By using the Sites, you are agreeing to the terms of this Statement.

Scope

This Privacy Statement applies to personal information collected on websites, mobile applications, or controlled widgets embedded in communication platforms (“Sites”) and personal information collected in connection with Stryker’s business operations, such as information from patients, health care professionals, employees’ human resource data or third party business associates or contacts. 

Personal information (also referred to as “Personal Data” in some jurisdictions) as used herein, is any information that can be used either alone or combined with other information to identify an individual or that can be directly linked to an individual.  In certain jurisdictions, personal information may also include network identifiers such as Internet Protocol (IP) addresses. 

This Privacy Statement describes Stryker’s collection, use, and distribution practices with respect to personal information. Stryker’s privacy practices may vary amongst Stryker businesses and countries, both on and offline. Stryker is not responsible for the content or privacy practices of third-party sites linked to or from www.stryker.com. 

You are encouraged to review the privacy policies of each website you visit.

Information collection

Stryker does not require you to provide Personal Information to access any portion of our public website with exceptions such as registering for a webcast or accessing certain secure web areas. Only Personal Information you voluntarily provide to us is collected.

Stryker maintains physical, technical, and administrative safeguards to protect your nonpublic personal information and only allow disclosures as permitted by law to assist in providing products or services. We may also collect product and service information and provide these statistics to others in an aggregate form where the information has been de-identified.  

Personal Information collected via Stryker Sites may include:

  • Contact information, such as name, address, email, telephone number, fax number, organization name, and/or job title.
  • Unique identifiers and preference information such as username, password, marketing preferences, internet protocol (IP) address, browser type, operating system, computer or mobile device, or navigation and clickstream behavior.

Stryker may collect, keep, and use Personal Information obtained through the Sites to provide you with access to the Sites.  This information may be collected when you: 

  • Register for an account; 
  • Request a product demo or receive information about our products;  
  • Request customer or technical support; 
  • Request Investor Relations information;  
  • Apply for employment;  
  • Request to be contacted; and/or,
  • Receive our products or services.

Legal basis for using Personal Information

  • Compliance with legal requirements or obligations - Stryker may disclose Personal Information as permitted or required by law when we believe in good faith it is necessary for safety purposes, required for legal reporting, necessary to protect our legal rights or enforce our Terms of Use or any applicable rules or to protect the rights of others. We may also disclose Personal Information to our auditors, legal advisors, or to respond to a judicial subpoena. 
  • For establishment or performance of a contract - The use of Personal Information may be necessary to perform the contract that you have with us. For example, when you work for us either as an employee or a service provider or apply for a job with us, your Personal Information will be necessary in connection with your contract of employment or services agreement.  Stryker similarly processes patient-related Personal Information provided to us by our customers to perform our contracts with them.
  • Consent - Stryker will rely on consent, which in some cases may be implied, to use technical information such as cookie data and geolocation data as described in this Statement.  Consent may be withdrawn at any time by contacting us through the mediums described within this Statement.  We may obtain Personal Information through healthcare professionals or users of our products and services, in which case that healthcare professional or product/services user is responsible for the management of consent, where required.
  • Legitimate interests - Stryker may use Personal Information for our legitimate interests to improve our products, services and website content and for administrative purposes.

If you choose not to provide the Personal Information we reasonably require, it may hinder Stryker’s ability to provide the information or services you have requested.

Online Advertising

Stryker advertises in a number of ways, including managed social media presences and email marketing campaigns. To analyze the performance of advertising campaigns, Stryker may collect certain information via our Sites through our service providers. Stryker and our service providers use common online surveying tools to collect this information, such as browser and flash cookies, web beacons and other similar technologies. The information that may be collected is listed in the Information Collection section above.

Collecting certain Personal Information through online advertising may assist with

  • Identifying new visitors to Sites or recognizing returning visitors; 
  • Analyzing the effectiveness of promotional content; 
  • Better understanding our audience, customers, or other Site visitors; 
  • Addressing customer inquiries; and,
  • Addressing security issues or resolving legal disputes 

Tracking Tools

Your browser may give you the ability to control cookies.  How you do so depends on your browser and the type of cookie.  Certain browsers can be set to reject all browser cookies. If you configure your computer to block all cookies, you may disrupt certain web page features and limit the functionality we can provide when you visit or use our Sites. If you block or delete cookies, not all of the tracking that we have described in this Policy will stop. Some browsers have a “Do Not Track” feature that lets you tell websites that you do not want to have your online activities tracked. These browser features are still not uniform, so we are not currently set up to respond to those signals.

Your browser may grant the ability to control cookies. Configuring computer settings to block all cookies may disrupt certain web page features and limit the functionality of our Sites. Blocking or deleting cookies does not guarantee all tracking described herein will stop. Browsers’ “Do Not Track” features are not yet uniform, so Stryker cannot guarantee responses to those signals.

Cross-border Transfer

To the extent personal information is transferred out of the country where the owner of that Personal Information lives, such as to Stryker affiliates or business partners in other countries, including in the United States, different standards may apply to how your data is used and protected in those countries. Stryker has appropriate safeguards in place in accordance with applicable legal requirements to ensure that data is adequately protected irrespective of the country. This includes obtaining written assurances from any third party given access to your data so as to require them to adopt standards that ensure an equivalent level of protection for data as that adopted by Stryker. If you prefer not to have your Personal Information transferred, do not use this Site. 

Privacy Statement for children

Stryker will not collect any Personal Information from anyone we know to be under the age of 16 without the prior, verifiable consent of his or her legal representative. Such legal representative has the right, upon request, to view the information provided by the child and/or to require that it be deleted.

How long we keep information

Stryker will retain your Personal Information for as long as reasonably necessary for legitimate business purposes.

Information sharing

Stryker may share Personal Information we have collected with companies or agents doing technological maintenance or working on our behalf to help fulfill business needs, including providing customer services and distributing marketing communications. Stryker may also share Personal Information with our subsidiaries and affiliates. 

Other service providers that may be used to perform certain functions on our behalf and to whom Personal Information may be disclosed in order to perform their intended function include call-center support, sending or processing postal or electronic mail or analyzing or hosting information on cloud-based servers. 

Stryker does not share your Personal Information with unaffiliated third parties for their own direct marketing purposes.

Security

The security and confidentiality of your personal information matters to us. For this reason, Stryker has physical, technical and administrative controls in place to protect your Personal Information from unauthorized access, use and disclosure. Stryker evaluates these safeguards on an ongoing basis to help minimize risks from new security threats as they become known. However, as is the case with all websites, Stryker is not able to guarantee security for data collected through our Site. 

Rights

You can contact us directly any time at the address below to update your Personal Information.  Certain Personal Information may still be retained in accordance with our internal record retention procedures and processes or to the extent necessary to comply with applicable law. 

If you are in the European Union, you also have a right to request access to, rectify, or erase your Personal Information. You also have a right to the objection to or restriction of processing, as well as the right to data portability, when applicable. If Stryker has processed your Personal Information based on your consent, you have a right to withdraw it at any time.

Stryker shall not be liable for any direct or indirect damages suffered by your access to, or use of, third party sites or any products, services or information contained therein.

Updates to Privacy Statement

This Privacy Statement may be amended at any time. If material changes are made in how Personal Information is collected, used, disclosed, or otherwise processed, this Statement will be updated and notices will be prominently posted on the home page of our primary Site. Any material changes to this Privacy Statement will be effective at the time of our posting of the notice of the update. Where required to do so by law, Stryker may seek your prior consent to any material changes we make to this Privacy Statement.
